Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Finalist (“Finalist”, “we”, “us”), a competitive gaming platform for organizing and playing esports tournaments and scrims. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Finalist.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use Finalist. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your account

• You are responsible for the activity that happens under your account and for keeping your credentials and linked sign-in providers (such as Discord or Google) secure.
• You must provide accurate information, including in-game names and team details, and keep it up to date.
• Accounts are for a single person. Do not share, sell, or transfer your account.

3. Acceptable use

When using Finalist, you agree not to:

• Cheat, use unauthorized software or exploits, manipulate results, or otherwise engage in unfair play.
• Harass, threaten, impersonate, or abuse other users, organizers, or staff.
• Upload or share content that is illegal, infringing, or that you do not have the right to share.
• Access the service through automated means except through interfaces we provide, or attempt to scrape, overload, or disrupt the platform.
• Circumvent bans, registration filters, or other restrictions, or attempt to gain unauthorized access to any account or system.

4. Tournaments, scrims, and organizations

Finalist is a platform that lets organizers create and run their own tournaments, scrims, and organizations. Organizers set their own rules and may open or close registration, accept or reject entries, assign slots, record results, and ban players or teams from their events. Finalist is not the organizer of these events unless expressly stated, and we are not responsible for an organizer’s conduct, decisions, rules, or any prizes they may offer. Disputes about a specific event should be raised with its organizer.

5. Your content

You retain ownership of the content you submit, including images you upload such as avatars, banners, and logos. You grant Finalist a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as needed to operate and provide the service. You are responsible for the content you submit and confirm that you have the rights to it. Images you upload to public galleries or profiles may be served publicly by URL.

6. Third-party integrations

Finalist integrates with third-party services such as Discord and Google. Your use of those services through Finalist is also subject to their terms and policies. Connecting a Discord server or account allows Finalist to send messages and notifications related to your events.

7. Fees

Some features may be offered for free and others as paid plans. If you purchase a paid plan, the applicable fees, billing, and refund terms will be presented to you at the time of purchase and form part of these Terms.

8. Intellectual property

The Finalist name, logo, software, and the design of the platform are owned by Finalist and protected by intellectual-property laws. These Terms do not grant you any right to use our branding without our prior written permission.

9. Suspension and termination

We may suspend or terminate your access if you violate these Terms or use the service in a way that harms Finalist or its users. You may stop using Finalist at any time and request deletion of your account. Provisions that by their nature should survive termination will continue to apply.

10. Disclaimers

Finalist is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure, or that any particular results, matches, or prizes will be delivered.

11. Limitation of liability

To the maximum extent permitted by law, Finalist and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunities, or profits, arising out of or related to your use of the service.

12. Indemnification

You agree to indemnify and hold Finalist harmless from claims and expenses arising out of your use of the service, your content, or your violation of these Terms or the rights of others.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and your continued use of Finalist after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of [your country/state], without regard to its conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the courts located there.
